Probably due to the economical crisis, a lot of people tend tot think it is not strictly necessary to employ a legal professional to assist them in their house-purchase or house-sale.
Most real-estate-agencies tend to say it is a waste of money. They do it also and for free! So they say....

People do not seem to realize a few problems here. The agents are often not professionally skilled nor trained and are only interested in getting their commission. The intervenience of a lawyer or solicitor is often experienced by them as someone who seeks problems where there aren´t. Of course these agents, although there are genuine ones, are never impartial. A lawyer or solicitor is, or at least, he thinks in your own interest only.

Buying houses in Spain should be easy, so why not? You do not need any assistance to buy a car or a pack of cigarettes, do you? So why would you need assistance when buying or selling a house in Spain?

Unfortunately, 99 % of the transactions in Spain are not “easy” and without any hick-ups. Often there are hidden legal problems with the paperwork or the property itself.

The agents gain normally thousands of euros on commission of the sale. You are paying for this! So if you are willing to pay them their commission, and mind you, it is only a sales-commission, not a fee for legal assistance, why not pay between 1.000 or 2.000 Euros on legal security and be sure to live happily ever after?

Please do not leave “your brain on the plane” when you get to Spain. You would never have a plumber fix your furniture, would you? Or your carpenter fix a valve in the bathroom? When you are ill you go to see a doctor, so when you need legal advice go to a lawyer or solicitor. These people are fully trained and skilled and will protect your interest. It is really worth-while, you will see.

And even if a lawyer or solicitor already assisted you in the purchase, do not hesitate to use these services as well when selling your property. There can be many legal and fiscal issues in which the right professional will be there again to help you out!

So, if you do not wish to be the next newspaper-story in the Costa Blanca, be smart, be wise and go for your best security.
